OVERVIEW

This website and online store are operated by Raging River of Peace Apparel. Throughout these Terms, “Raging River,” “we,” “us,” and “our” refer to Raging River of Peace Apparel.

These Terms of Service apply to our website, online store, custom-order services, business storefronts, direct invoices, products, and related services. By accessing our website, submitting a custom-order request, approving a design, placing an order, or paying an invoice, you agree to these Terms.

If you do not agree to these Terms, please do not use our website or purchase our products or services.

  1. ELIGIBILITY

You must be at least the age of majority in your state or have permission from a parent or legal guardian to place an order. You agree to provide accurate and complete contact, billing, shipping, and order information.

  1. PRODUCTS AND AVAILABILITY

Most products are customized, personalized, or produced on demand. Product availability, garment styles, colors, materials, sizing, and fulfillment options may change without notice.

We make reasonable efforts to display product colors and details accurately. However, colors may appear differently depending on the screen, garment material, printing process, and production batch. Mockups are representations of the expected product and may not show every minor production variation.

We may limit quantities, discontinue products, correct errors, or refuse an order when reasonably necessary.

  1. CUSTOM AND PERSONALIZED ORDERS

Customers are responsible for reviewing and confirming all order details, including:

• Names and spelling
• Sizes and quantities
• Garment styles and colors
• Artwork, wording, and dates
• Design placement and orientation
• Shipping information
• Required completion dates

Production may begin after the required payment or deposit is received and the design or order details are approved.

Once production begins, changes or cancellations might not be possible. Requested changes may require additional payment and may extend the production timeline.

An approved design proof or mockup controls the spelling, wording, layout, and general appearance of the finished product. Customers should carefully review every detail before providing approval.

  1. CUSTOMER-PROVIDED ARTWORK AND CONTENT

By submitting a logo, photograph, design, name, slogan, trademark, or other content, you confirm that you own it or have permission to use and reproduce it.

You grant Raging River of Peace Apparel a limited, non-exclusive license to use, reproduce, resize, adjust, display, and provide the submitted content to our production and fulfillment partners as reasonably necessary to complete your order or maintain an authorized business storefront.

You remain responsible for claims resulting from artwork or content you supplied without proper authorization.

We may refuse content that is unlawful, threatening, defamatory, discriminatory, obscene, deceptive, infringing, or otherwise inappropriate for production.

  1. PRICING, TAXES, AND PAYMENT

All prices are listed in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, personalization costs, design fees, size surcharges, rush fees, or other charges may be added before payment.

Prices may change without notice before an order is accepted. A price change will not affect a completed order unless there was an obvious pricing or technical error.

Payment must be successfully completed before production unless different written arrangements appear on an invoice. Deposits and payment schedules are governed by the terms shown on the applicable invoice or written agreement.

Direct invoices may contain additional terms specific to that order. When a direct invoice conflicts with these general Terms, the specific written invoice terms control for that order.

  1. ORDER ACCEPTANCE, CHANGES, AND CANCELLATIONS

Receiving an order confirmation does not guarantee acceptance. We may cancel or refuse an order because of product unavailability, payment problems, suspected fraud, pricing errors, fulfillment limitations, unauthorized artwork, or violations of these Terms.

If we cancel a paid order before production for a reason unrelated to customer misconduct, the applicable payment will be refunded.

Customer-requested cancellations are not guaranteed once artwork preparation, product ordering, or production has begun. Any approved refund may be reduced by costs already incurred.

  1. PRODUCTION AND SHIPPING

Production and delivery dates are estimates, not guarantees. Timelines may be affected by product availability, customer approval delays, weather, carrier delays, equipment issues, supply-chain interruptions, or fulfillment-provider circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional costs caused by an incorrect or incomplete customer-provided address may be the customer’s responsibility.

We may use third-party production, fulfillment, and shipping providers. Customers must direct order questions and claims to Raging River of Peace Apparel rather than contacting our fulfillment partners.

  1. RETURNS, REPRINTS, AND REFUNDS

Our Return and Refund Policy is incorporated into these Terms.

Because most products are customized or made to order, purchases are generally final unless an item arrives damaged, defective, misprinted, incorrect, or materially different from the approved order.

Eligible discrepancies must be reported within 30 calendar days of delivery by emailing rropapparel@gmail.com. The email must include the customer’s name, order number, description of the issue, and clear photographs showing the item and discrepancy.

Returns, exchanges, or refunds are generally unavailable for ordering the wrong size or color, changes of mind, customer-provided artwork errors, approved design details, normal wear, improper care, or damage occurring after delivery.

Approved claims may be resolved through a reprint, replacement, store credit, or refund, depending on the circumstances and product availability.

  1. BUSINESS STOREFRONTS

Business storefronts may contain products using logos or designs authorized by the applicable business or organization.

The person requesting a business storefront confirms that they have authority to approve the use of the submitted name, logo, and artwork.

Creating a storefront does not transfer ownership of a business’s logo or intellectual property to Raging River of Peace Apparel. We may update, pause, reorganize, or remove storefront products when requested by the authorized business, when products become unavailable, or when continued use would violate these Terms or applicable law.

  1. ACCOUNTS AND STORE INFORMATION

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activities conducted through your account.

You agree to promptly update your email address, payment information, shipping address, and other account details when they change.

  1. PROHIBITED USES

You may not use our website, products, or services to:

• Violate any applicable law or regulation
• Infringe another person’s copyright, trademark, privacy, publicity, or other rights
• Submit false, fraudulent, misleading, or unauthorized information
• Transmit malicious code or interfere with website security
• Scrape, copy, reproduce, or commercially exploit store content without permission
• Harass, threaten, discriminate against, or harm another person
• Attempt to gain unauthorized access to an account, system, or customer information

We may suspend or terminate access for prohibited conduct.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website, Raging River branding, original designs, photographs, written content, graphics, and store materials are owned by or licensed to Raging River of Peace Apparel.

Customer-owned logos and artwork remain the property of their respective owners.

Nothing in these Terms grants permission to reproduce, resell, distribute, or commercially use our original content or designs without written authorization.

  1. THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify and may use third-party services for payment processing, production, fulfillment, shipping, forms, analytics, and other business functions.

Third-party websites and services may have their own terms and privacy policies. We are not responsible for third-party content or services outside our reasonable control.

  1. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy. Information necessary to process and fulfill an order may be shared with Shopify, payment processors, production partners, fulfillment providers, shipping carriers, and other service providers as described in that policy.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or error-free.

Nothing in these Terms excludes any warranty or consumer protection that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Raging River of Peace Apparel will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, products, delayed delivery, lost profits, or use of our services.

Our total liability relating to a product or order will not exceed the amount the customer paid for the affected product or order.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

  1. INDEMNIFICATION

You agree to indemnify and hold Raging River of Peace Apparel harmless from claims, losses, liabilities, and reasonable expenses resulting from your violation of these Terms, misuse of our services, or submission of artwork or content that infringes another person’s rights.

  1. SEVERABILITY AND WAIVER

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

  1. TERMINATION

We may suspend or terminate access to our services when a customer violates these Terms, engages in fraudulent or abusive conduct, or uses our services unlawfully.

Obligations relating to payment, intellectual property, liability, indemnification, and other provisions that reasonably should continue will survive termination.

  1. ENTIRE AGREEMENT

These Terms, our Privacy Policy, Return and Refund Policy, Shipping Policy, applicable invoice terms, and any written order agreement constitute the entire agreement concerning an order or use of our services.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Michigan and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms limits any non-waivable consumer right provided by applicable law.

  1. CHANGES TO THESE TERMS

We may update these Terms periodically. Changes become effective when posted unless a later effective date is stated.

Continued use of the website or services after updated Terms are posted constitutes acceptance of those changes to the extent permitted by law.
